Designated Area Migration Agreements (DAMA)

DAMAs provide access to more overseas workers than the standard skilled migration program. They are tailored to the needs of specific regions.

  • Check if your business is in a DAMA region (e.g., Orana, Far North Queensland).
  • Verify the occupation is on the DAMA occupation list.
  • Seek endorsement from the DAMA Representative (DAR).
  • Apply for a Labour Agreement with the Department of Home Affairs.

Horticulture Industry Labour Agreement (HILA)

The HILA allows horticultural employers to sponsor overseas workers for skilled and semi-skilled roles where Australian workers are unavailable.

  • Demonstrate that you are an eligible horticultural employer.
  • Show that you have attempted to recruit locally first (LMT).
  • Comply with the Horticulture Award 2020 salary requirements.

Employer Sponsorship Obligations

Becoming an approved business sponsor is a serious commitment. You must meet specific obligations to ensure your business remains compliant.

  • Ensure equivalent terms and conditions of employment (no exploitation).
  • Keep records of recruitment and employment.
  • Pay all costs associated with sponsorship (do not recover from worker).
  • Inform the Department of any changes in circumstances (e.g., worker leaves).

Worker Rights in Australia

All workers in Australia, including visa holders, have the same workplace rights and protections.

  • Right to minimum wage and superannuation.
  • Right to a safe workplace.
  • Right to join a union.
  • Protection from unfair dismissal (where eligible).
